Terms of use

1. Purpose
These terms govern access to and use of the Murmure mobile app and web studio (the Service), provided by Steffen Guillaume, sole proprietor (entrepreneur individuel), 25 boulevard commandant Autran, 06130 Grasse, France. By using the Service, you accept these terms.
2. Service
Travellers can listen to audio tours, including offline. Guides can create and publish tours through the web studio. Some features or tours are free and others are paid.
3. Account
An account may be required for some features. You are responsible for accurate information, keeping credentials confidential and meeting the applicable minimum age.
4. Creator content
Guides remain responsible for their recordings, text, images and locations and must hold the necessary rights. Content may be moderated, refused or removed when it breaks these terms or the law. Guides keep full ownership of their content; by publishing, they grant Murmure a non-exclusive, worldwide, royalty-free licence, for as long as the tour is published, to host, distribute, translate and technically adapt it within the Service. For paid tours, the guide’s share is the one shown in the studio at publication time.
5. Intellectual property
The Murmure service, brand, design and software are protected. No ownership rights are transferred except for licences expressly granted for operating the Service.
6. Purchases and subscriptions
Mobile purchases are processed by Apple or Google and web purchases by Stripe. Subscriptions renew until cancelled through the relevant platform. Mobile refund requests go to Apple or Google. For web purchases, digital content is made available immediately after payment: in line with French consumer law (article L221-28 13°), you agree that performance starts at once and waive the fourteen-day withdrawal right. If a purchased tour is faulty or unavailable, contact us and we will fix it or refund you.
7. Acceptable use
You must not misuse the Service, seek unauthorised access, or publish illegal, misleading or rights-infringing content.
8. Liability and safety
The Service is provided as available. Audio tours use location information; remain aware of traffic, signs, restricted areas and your surroundings while walking.
9. Personal data
Our handling of personal data is described in the privacy policy.
10. Termination
You may stop using Murmure and delete your account at any time. Access may be suspended or closed when these terms are breached.
11. Governing law
These terms are governed by French law. Parties will first seek an amicable resolution; consumers may also use free consumer mediation (French Consumer Code, articles L611-1 et seq.). Failing that, French courts have jurisdiction, subject to mandatory consumer protection rules.
